have established the following terms and conditions.
By using this web site and/or services, you are indicating your acceptance
of the following Terms and Conditions. ExecutiveTrumpet may revise these
Terms and Conditions by updating this posting. The terms "You"
and "User" are used to refer to all individuals and/or entities
accessing this web site for any reason. The term "the Company"
refers to ExecutiveTrumpet. The term "executive recruiter" refers
specifically to those who are registered with ExecutiveTrumpet to receive
resumes. The term "candidate" refers to those that pay to have
their details sent to targeted recruiters from the ExecutiveTrumpet.com
network.
Terms Specific to Recruiters
By signing up to receive resumes from www.ExecutiveTrumpet.com you agree
to the following:
- You are representing a bona fide employer or search firm engaged in
$75k+ contingency or retained placements.
- You will not contact ExecutiveTrumpet candidates for any reason other
than for bona fide career opportunities that would be considered normal
and customary employment. No multi-level marketing (MLM), get rich quick
schemes, work at home email processing jobs or any opportunity that
would cause a candidate to have to make a personal investment will be
presented to a referred candidate, via email, phone, fax or direct mail
or any other method.
- You will not charge or offer to charge any candidate referred by ExecutiveTrumpet
for any of your services.
- You agree not publish a candidate's personal information in a database
that can be viewed by others not associated with your firm or send the
candidate's personal information to others outside your firm without
the candidate's permission.
- You will not send Unsolicited Commercial Email (SPAM) to any candidate
referred to your firm by ExecutiveTrumpet. Auto responses are permitted
identifying your particular search firm practice or search firm website,
no other advertisements are permitted without prior approval of ExecutiveTrumpet.
- ExecutiveTrumpet reserves the right to change or modify these terms
without warning.
- TERMINATION: ExecutiveTrumpet has the right to terminate any recruiter
account for any reason whatsoever without liability to you.
- You agree that through your use of the ExecutiveTrumpet website to
agree to abide by US Federal and State laws.
- INDEMNITY: You agree to defend, indemnify, and hold harmless ExecutiveTrumpet,
its officers, directors, employees, and agents from and against any
claims, actions, or demands, including without limitation reasonable
legal and accounting fees, arising from your use of the materials or
your breach of the terms of this Agreement. ExecutiveTrumpet shall provide
notice to you of any such claim, suit, or proceeding and shall assist
you, at your expense and in our discretion, in defending any such claim,
suit or proceeding.
Acceptable Site Use
General Rules: Users may not use the Web Site in order to transmit, distribute,
store or destroy material (a) in violation of any applicable law or regulation,
(b) in a manner that will infringe the copyright, trademark, trade secret
or other intellectual property rights of others or violate the privacy,
publicity or other personal rights of others, or (c) that is defamatory,
obscene, threatening, abusive or hateful.

Users are prohibited from violating or attempting to violate the security

users who are involved in such violations.

career information and/or services as offered on the Website. The Company
specifically prohibits any use of the Web Site, and all users agree not

Liability

Web site or the material results in the need for replacing or servicing
equipment or data, the Company is not responsible for these costs.
We do our best to effectivley distribute users' resumes to relevant recruiters.
A satisfaction guarantee is offered to those that invest in one of ExecutiveTrumpet's
services; details of which can be found on the Website. Other than the
satisfaction guarantee, which applies to purchasers of the resume distribution
services only, the Company, disclaims all other warranties, whether express
or implied, including the warranty of merchantability, fitness for a particular
purpose and non-infringement.
The Company makes no warranties about the accuracy of reliability, completeness
or timeliness of the material, services, software, text, graphics and
links.
Disclaimer of Consequential Damages
Other than a refund of any monies paid to the Company, the Company, its
suppliers or any third parties mentioned on the website will not be liable
for any damages whatsoever (including, without limitation, incidental
and consequental damages, lost profits, or damages resulting from lost
data or business interruption) resulting from the use or inability to
use the website and the material, whether based on warranty, contract,
tort, or any other legal theory, and whether or not the Company advised
of the possibility of such damages.

The Web Site contains links to third party web sites. These links are
provided solely as a convenience to you and not as an endorsement by the
Company of the contents on such third-party Web sites. The Company is

The aggregate liability for the Company to you for all claims arising
from the use of the Materials is limited to two-hundred dollars.

directors, employees and agents, from and against any claims, actions
or demands, including without limitation reasonable legal and accounting
fees, alleging or resulting from your use of the Material or your breach
of the terms of these Terms and Conditions.

The Company makes no claims that the Materials may be lawfully viewed
or downloaded outside of the US. Access to the Materials may not be legal
by certain persons or in certain countries. If you access the Web Site
from outside of the US, you do so at your own risk and are responsible
for compliance with the laws of your jurisdiction. If any provision of
these Terms and Conditions are found to be invalid by any court having

these Terms and Conditions shall be deemed a further or continuing waiver
of such term or any other term. Except as expressly provided in additional

or Software License or material on particular Web pages, these Terms and
Conditions constitute the entire agreement between you and ExecutiveTrumpet.co.US
with respect to the use of Web Site. No changes to these Terms and Conditions
shall be made except by a revised posting on this page.
Intellectual Property Rights
The entire copyright and any other intellectual property rights in the
Web Site (including any Software on the Web Site) throughout the universe
and all rights in the domain name of the Web Site, the names "ExecutiveTrumpet",
"Executive Trumpet", "executive trumpet" and "ExecutiveTrumpet.com"
shall be and shall remain the exclusive property of ExecutiveTrumpet or
its licensors. Other than the rights expressly granted in these Terms
and Conditions, the Client obtains no rights in the Web Site. All content
included on the Company's Web Site, such as text, graphics, logos, button
icons, images, video and audio clips and software is the property of the
Company or its contents suppliers and protected by US and International
copyright laws. The compilation (meaning the collection, arrangements
and assembly) of all content on this Web Site is the exclusive property
of ExecutiveTrumpet and protected by U.K. and international copyright
laws. All software on this Web Site is the property of ExecutiveTrumpet
or it's software suppliers and protected by US and International copyright
laws. Any other use, including the reproduction, display or performance
of the content on this Web Site is strictly prohibited.
